TUCSON, ARIZONA – December 1, 2021 – Earlier today, the Pima County Attorney’s Office (PCAO) released the statement below to media outlets regarding the fatal officer-involved shooting outside the Lowe’s on Valencia Road on Monday, Nov. 29, 2021:
“PCAO, The People’s Office, holds sacred the impartial review of the facts of every incident referred to us. Once we receive the evidence in this incident, we will conduct such a review. Until such time, we will not comment further on this matter.”
Since releasing the above statement, it has become important to clarify that PCAO does not make arrests; any arrest that may be made in this case would be by the law enforcement agency investigating the incident, which, in this case, is the Tucson Police Department (TPD). TPD’s duty is to determine if probable cause to make an arrest exists. PCAO’s duty is to determine, based on evidence, whether or not criminal charges are warranted. While PCAO anticipates receiving evidence from TPD sometime next week, no evidence has been delivered to PCAO as of yet.
PCAO’s review of this incident will neither be influenced nor rushed by media coverage or public opinion. Once PCAO completes its review of the evidence, it will update the public.
